1. Acceptance of Terms

By accessing or using Momentum, you confirm that you are at least 13 years of age and have the legal capacity to enter into these terms. If you are using the app on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Description of Service

Momentum is a voice-first personal development and knowledge management application. The app provides features including voice capture and transcription, AI-powered note organization, habit tracking, goal setting, calendar synchronization, and an AI conversational assistant. Some features require a paid subscription.

3. Account Registration

You may be required to sign in using Sign in with Apple to access certain features. You are responsible for maintaining the security of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

• Use the app for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to gain unauthorized access to our servers, systems, or other users' accounts
• Reverse engineer, decompile, or disassemble any part of the app
• Use the app to transmit any harmful, abusive, or objectionable content
• Interfere with or disrupt the integrity or performance of the app or its servers
• Use automated means (bots, scrapers, etc.) to access the app without our prior written consent
• Resell, redistribute, or sublicense access to the app or its features

5. Subscriptions and Payments

Momentum offers subscription-based access to premium features. Subscriptions are billed through Apple's App Store and managed by RevenueCat. By subscribing, you agree to the following:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your device's Settings under Subscriptions
• No refunds are provided for partial subscription periods

6. Intellectual Property

All rights, title, and interest in and to Momentum — including its design, code, graphics, logos, and AI models — are owned by us or our licensors. These terms do not grant you any rights to use our trademarks or branding.

You retain ownership of the content you create within the app (notes, voice recordings, etc.). By using the app, you grant us a limited license to process your content solely for the purpose of providing the app's features, including AI-powered transcription, organization, and analysis.

7. AI-Generated Content

Momentum uses artificial intelligence to transcribe, organize, and provide insights on your content. AI-generated responses are provided for informational purposes only and should not be relied upon as professional advice (medical, legal, financial, or otherwise). We do not guarantee the accuracy, completeness, or reliability of AI-generated content.

8. Privacy

Your privacy is important to us. Our use of your personal information is governed by our Privacy Policy, which is incorporated into these terms by reference.

9. Disclaimers

The app is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Momentum or its affiliates, officers, employees, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the app, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from these terms or your use of the app shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Termination

We may suspend or terminate your access to the app at any time, with or without cause, and with or without notice. Upon termination, your right to use the app ceases immediately. You may delete your account at any time through the app's Settings. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.

12. Changes to These Terms

We reserve the right to modify these terms at any time. Material changes will be communicated through the app. Your continued use of the app after changes are posted constitutes your acceptance of the updated terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the app shall be resolved in the courts located in San Francisco County, California.
